Taking into account, if you leave by car once a week or even once a month, then many people choose to pay a fine rather than renewing insurance. As statistics show, there are more and more such drivers, and this is a sign that an increase in the amount of the fine is not far off, from the beginning of 2018 they want to increase it to 2,000-5,000 rubles.

If you got into an accident with expired OSAGO insurance

It's good if you, with an expired OSAGO, have never been stopped by a traffic police inspector. But what to do in a situation when you got into an accident with expired OSAGO insurance. In such a situation, regardless of whether you are guilty or not, you will be fined at least 800 rubles. Further, the situation may unfold according to the most unpredictable scenario.In the event that you are the culprit of the accident, then the entire amount of damage will definitely be written off on you and you will have to pay from your pocket, and the delay in CTP will be recorded in the certificate of the accident. The victim, in turn, is obliged to make an independent examination in order to assess the amount of damage, while notifying you in writing about the conduct of this procedure. Often in such a situation, they try to solve everything on the spot, without bringing the matter to court and disassembling about the availability of OSAGO insurance. If a compromise is reached with the injured party, be sure to take from him a receipt on receipt of the sum of money and the absence of any claims.

If you are an injured party in an accident and the compulsory motor third party liability insurance is expired, then at most you will be issued a penalty for delay. In this case, you will receive compensation for damage.

What if there is no OSAGO insurance?

You can be fined for the delay in the MTPL policy, but what if there is no insurance at all. The most primitive example is when you forgot your home insurance, in which case the inspector, at his discretion, can issue you a warning or draw up a fine of 500 rubles. If someone from your friends or relatives can bring the MTPL insurance from home before drawing up the protocol, then all problems will be solved automatically. You can also add in the protocol that you do not agree with this decision and within 10 days you can appeal the decision and not pay the fine by presenting the original of the OSAGO insurance.

There are at least two more situations when they can write out a fine for driving without OSAGO insurance. The first is when the driver of the vehicle is not included in this policy, the second is the operation of the vehicle during the period not provided for by the insurance contract. Each insurance contract is concluded for a maximum of one year, while the service life of the vehicle may differ, at least from 3 months to a year. Accordingly, the cost of an OSAGO insurance policy will differ downward. If the traffic police inspector stops you outside the validity period of the insurance (not the CMTPL agreement), a protocol and a fine for driving without CMTPL is unconditionally drawn up from 500 to 800 rubles.

No less interesting can be the situation when you have not been issued OSAGO insurance at all. This usually happens on company cars, when there was no time to issue a policy or you were simply not included in it. The fine is inevitable, but if there is a passenger next to you who is included in the CTP insurance policy of this vehicle, then this will not be considered a violation of the law and you will not have to pay a fine.

It is worth noting that in such situations, only a fine of 500 rubles is provided, and it will be limited to a warning, the inspector has no right.


These are the main options when there is no insurance and the punishment for driving without compulsory motor third party liability insurance. But do not forget that drivers simply decide to refuse insurance, thereby automatically falling into the list of violators. Most often this can be found in the outback, where insurance is not mentioned at all. Recall that even the most experienced driver can become the culprit of an accident. MTPL insurance can close the financial part at the most, if all the rules in the contract were observed, for today the maximum payment is 400 thousand rubles.

What is the penalty for driving without OSAGO insurance?

Despite loud reservations from the government about increasing fines for expired OSAGO insurance or driving without an insurance policy, as of 2017, the amount of the fine does not exceed 800 rubles. It is worth agreeing that in comparison with compensation for losses, in the event of an accident, this is a meager amount and does not even compare. Therefore, it is better not to be greedy, and in most situations, renew or conclude a new OSAGO insurance contract.

Still, the above situations are not excluded, and the traffic police inspector can write you a fine. If you forget the policy, the fine is 500 rubles, although in such a situation the inspector will still need to prove that you do not have such insurance. A similar amount of the fine will be charged if you are not included in the insurance or not at all. The largest penalty for overdue OSAGO insurance will be 800 rubles.

Well, the final decision on how to deal with insurance remains with the driver of the vehicle, but as practice shows, it is better not to play with it and not save money, since there are enough unpredictable situations on the road, besides, the option of increasing the amount with a fine in the near future is not excluded.
